The car was originally bought for the co-signer but because I was the member of the finance company, I was told that I had to be the primary on the account. The co-signer has had possession of the vehicle since it was bought and was making payments on time up until June of this year. He then waited 3 months before making a lump sum payment for those 3 months because they were going to repossess the car. Now as of today he still owes his Sept, Oct, Nov and Dec's car payment. Do I as the primary person on the loan have the right to go and get the car?

I think you can take the car back but you should ask a lawyer before you do that and when you do take it back, let the police know what you're doing because he/she might report it stolen. Good luck

Not unless your name is also on the registration and title.



Generally speaking, if the primary doesn't make the payments, they will go after the co-signer for payments, so since he is the co-signer they will go after him for the payments. However, as the primary, this IS affecting YOUR credit and you will be shown as 90 days behind in your payments.



If they do repossess the vehicle, you will have a repossession on YOUR credit report. This is why it's never a good idea to sign for someone else.



If I were you, I would go talk to this person, and tell him to either get the payments up or give you the keys.
